    The Bank Secrecy Act gives the Secretary of Treasury the power to exempt whole groups of people from the filing requirements. In other words, bona fide residents of foreign countries should be exempt completely from the FBAR requirement. Thus, we can blame the IRS for the stupid application of a stupid law. Congress is not the only one to blame.

    Also, the IRS came up with the OVDI programs. And even the Tax Advocate Nina Olsen has said that they are administrating this program in a manner which is unfair to minnows. The IRS is to blame for this. Congress didn’t create OVDI.

    Your remarks certainly have validity. The rules – or should we say lack of rules – and guidance from the IRS on OVDI is particularly frustrating. Still, we think much of the blame belongs with Congress and the administration.
